SDK License Agreement (EULA)

Updated October 28, 2026

Draft for review before paid launch. Business details and these policies are being finalized.

Scope and acceptance

This SDK License Agreement is the end-user license agreement for the Immersed Advertising Unity SDK (RemoteBillboard1, AdViewTracker, ImmersedAdsPrivacy and any later SDK files), its documentation and sample code (together, the SDK), provided by Immersed Advertising. It forms part of the Terms of Service and includes the Data Sharing Addendum, which sets out how you and we share and protect player data. By downloading, copying or integrating the SDK you accept it. If you accept for a company, you confirm you can bind it. If you do not agree, do not use the SDK.

License grant

While your developer account is in good standing, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable, royalty-free license to copy the SDK into games you have registered on the platform, modify it only as needed to integrate it, and distribute it in compiled form inside those games to display Immersed Advertising ads and report views. You may let contractors do this for you if they follow this agreement; you are responsible for them.

Restrictions

You may not: use the SDK with any ad network or service other than ours; display advertising or paid promotion from any other source in a game that contains the SDK, or break the rules that apply after you leave (see Exclusive advertising in the Terms of Service); change it to fabricate, inflate or misreport views, screen coverage, receipts or player consent; remove or bypass its privacy switches; hide, overlay or disguise ads while they are reported as visible; distribute the SDK source on its own or as a competing product; remove legal notices; or use it in games directed to children under 13. Reverse engineering is prohibited except to the extent applicable law expressly permits it despite this restriction.

Game keys and security

Each game's API key identifies your game to our servers. It is shipped inside your game, so it is not secret from players, but you must not share it with other games or publish it for others to use. Rotate it from your dashboard if it is misused. Traffic sent with your key is attributed to your game.

Data the SDK collects

The SDK sends a random session identifier created for each launch of the game (never derived from the device and never saved), the platform, view measurements and timestamps. It never reads or sends a device identifier, advertising identifier or the device's region setting, never asks players for location permission, and stores nothing on the player's device; ad images are kept in memory only. When location matching is on (it is always off for players in the EU, EEA and UK), our servers estimate the player's country and state or province from the IP address of each ad request and store only that; they do not store IP addresses or user agents. Our Privacy Policy and the Data Sharing Addendum describe how we use this data. You have the direct relationship with players: you must provide the player notice described below and, if your game lets players turn location matching off, pass that choice to the SDK through ImmersedAdsPrivacy.

What to tell your players

Your game's own EULA or privacy notice must disclose, at minimum: that the game shows third-party advertising served by Immersed Advertising inside the game world; that ads may be redrawn by AI to match the game's art style; that, while location matching is on and outside the EU, EEA and UK, Immersed Advertising uses the player's IP address with each ad request to estimate their country and state or province for choosing ads, without storing it; that ad views are measured with a random identifier that changes every launch and nothing is stored on the player's device; and a link to our Privacy Policy. Suggested wording: “This game shows in-game advertising provided by Immersed Advertising. Ads may be adapted by AI to fit the game’s art style. Immersed Advertising records which ads were seen using a random identifier that changes every time you start the game and, outside the EU, EEA and UK, estimates your country and state or province from your IP address to choose ads (the IP address itself is not stored). No device identifier is collected and nothing is stored on your device. See Immersed Advertising’s Privacy Policy for details.”

Ad disclosure in your game

Ads must stay recognizable as advertising. Do not present an ad as your own content, a game reward, an endorsement by a character or an in-world fact. Do not require or reward players for looking at ads. Keep billboards in normal view; do not place them where players are forced to watch or cannot tell they are ads.

Updates

We may release SDK updates to fix defects, meet legal requirements or change reporting. Security, privacy and billing fixes may be required: after reasonable notice, reports from outdated versions may be rejected or not paid. We may change or discontinue the SDK, with notice where practical.

Ownership and feedback

We and our licensors own the SDK and all rights not expressly granted to you. You own your game. If you send suggestions about the SDK, we may use them without obligation to you.

Third-party components

The SDK runs inside Unity, which is licensed to you by Unity Technologies under its own terms. Any third-party notices we include with the SDK apply to those components.

Termination

We may suspend or end this license at any time for any reason, to the extent law allows. It also ends automatically if your developer account closes, your game is removed, or you breach this agreement. On termination, stop distributing new builds that contain the SDK and remove it from your games at their next update. Builds already in players' hands may keep running, but ads and earnings may stop. The sections on restrictions, ownership, warranty disclaimer, liability and governing terms survive.

Warranty disclaimer

The SDK is provided as is and as available. To the extent law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement and that the SDK is error-free, compatible with every Unity version or platform, or will always serve or count ads. You are responsible for testing each game build.

Limitation of liability

The liability limits in the Terms of Service apply to the SDK. To the extent law allows, we are not liable for lost revenue, lost players, store rejections, game crashes or data loss arising from the SDK beyond those limits. Nothing here limits liability that cannot lawfully be limited.

Export and sanctions

You may not use the SDK in, or distribute games containing it to, countries or persons subject to comprehensive US sanctions, or where US export laws prohibit it.

Governing terms

This agreement is governed by the same law, dispute and change provisions as the Terms of Service. If this agreement and the Terms conflict about the SDK, this agreement controls.
